Terms of Service

TŌT is currently a private beta intended only for people who are at least 18 years old. By using TŌT you represent that you are 18 or older, that the account information you provide is accurate, and that you are responsible for keeping your account credentials secure and for activity under your account.

TŌT lets people create visual comparisons and questions (“TŌTs”) and lets other people vote, comment and interact with them. Community results are the opinions of the people who happened to vote — they are not professional advice, and TŌT does not guarantee that any community choice is correct, suitable or representative.

You keep ownership of the photos and other content you upload. You grant TOT LLC a worldwide, non-exclusive, royalty-free license to host, reproduce, display, distribute, resize, process and promote that content as reasonably necessary to operate and market TŌT. We do not claim ownership of your photographs.

You represent that you have the rights needed to upload your content. You may not upload infringing, illegal or unauthorized material. We may remove or restrict content or accounts that violate these Terms. Deleting content or your account may not instantly remove copies from backups, logs or content already lawfully shared or processed, as described in our Privacy Policy.

You may not use TŌT for:

• unlawful content or activity;
• copyright or trademark infringement;
• impersonation of another person;
• harassment, threats, or hateful or abusive content;
• pornography or sexual exploitation of any kind;
• any content exploiting minors;
• malware, spam or scams;
• manipulation or fraud, including automated abuse of voting or accounts;
• attempts to defeat the platform’s security or integrity.

Votes reflect only the people who chose to participate. Results can change as more votes arrive. We may exclude fraudulent, test or otherwise invalid activity from results. TŌT does not guarantee the statistical validity or representativeness of any result.

We may modify or discontinue features, moderate or remove content, suspend or terminate accounts, and take steps we consider reasonable to protect the security and integrity of the platform.

TŌT may in the future include external links, affiliate links, commerce features or third-party services. We are not responsible for third-party content, products or services, and their inclusion does not imply endorsement.

TŌT is provided “as is” and “as available”. We do not guarantee that the service will be uninterrupted or error-free, and we make no warranty regarding user-generated content or community decisions, to the fullest extent permitted by law.

To the fullest extent permitted by law, TOT LLC will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, arising from your use of TŌT. Where liability cannot be excluded, it is limited to the greatest extent the law allows.

You agree to indemnify and hold harmless TOT LLC from claims arising out of your content, your misuse of TŌT, or your violation of another person’s rights, to the extent permitted by law.

These Terms are governed by the laws of the Commonwealth of Massachusetts, United States, without regard to conflict-of-law rules.

We may update these Terms from time to time. We will post the updated version on this page and, for material changes, we may require you to accept the new version before continuing to use TŌT. The version date is shown at the top of this page.
